My wife is currently applying for labor certification and I am planning to start my process for green card also. Is it advisable for both of us to apply for the green card? Is it considered duplication by the INS?

The reason for both of us starting the green card is that in case one of us has to move to a different job the other green card application might serve as a backup.

Please advise.

It's true that Obama is focusing on the economy now, but if we do a massive flower campaign now it will get us press and attention and "loosen" things up, then we can go for a second even bigger flower campaign in the spring and in the summer when the previous flower campaign will still be alive in the public's memory. That way people will say "wait, legals? that's different than illegals, and it sounds serious"

We need to get ourselves noticed! The illegals had Obama on the Hispanic radio show with "Piolin Sotelo" last week. Why aren't we doing anything? We are not cowards, are we? The illegals can but we legals can't?

yes. ur 140 is still valid. you don't need paystubs from company A, but its better to be working for company A the time you are filing 485 with them to make your case more authentic.

Hi,

My husband is on H1-B, and it expires on Feb 4th 2007. We plan to go to India, leaving the U.S. on Feb 11th 2007. His current I-94 expires on Feb 4th 2007.

We have our I-140 and 485 filed in parallel. He has received his EAD and Advanced Parole.

His lawyer wants to apply for H1-B but not use premium processing, as he can re-enter the U.S. using Advanced Parole.

Now, our concerns are these:

1. If he leaves the U.S. AFTER the expiration of his current I-94 WITHOUT having a new I-797, can it look as if he overstayed?

2. If he re-enters the U.S. using the Advanced Parole, will that change his status so that he is now considered to be on immigrant(EAD) rather than non-immigrant (H1-B) status?

Basically, we want to insist on premium processing and go for the H1-B visa stamp while in India to be sure that he does not go out of status.

Any advice on this?

I am on an H1B visa. I have passed PERM and my priority date is Sep 2005. Then I applied to 140 and in the middle of 140 (it was last year in Aug), I changed my company. My new employer hired me for the same position and renewed my H1B for the same position. After a few months 140 was approved but it is from my old company.

Now, can I still apply to 485 even though I don't work for my previous company? In what circumstances, could this be worked out? what do I need to do?

HAS ANYBODY EXPERIENCED THIS BEFORE?

You can file for FOIA to get it from USCIS if attorney is not cooperative. When was the labor filed? How much time it took to get approved.Just to get an idea on the timelines USCIS working on labor these days

Hi,

My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.

Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

Hi Folks,

I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.

My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..

Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..
