Hi,
I hold a H1B Visa from Company A, which is valid until Sep 2010. I have not used this Visa since the stamping is done.
I am working in India from an X Company and because of the recession and bad job market at US, I did not make use of my H1B Visa.
But now my Employer (Company A) has an in-house project in US. So, I am planning to enter US on my H1B Visa now.
1) What documentation is required to show at the Port of Entry?
2) Since my Visa is going to expire by Sept 2010, which is just 6 months validity, will there be any issues / queries at the Port of Entry.

Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?
Birth certifcate is a good document to prove the genuineness of the ties with people you claim to be your parents and whom you are trying to get here.
Its good to show it if you have it. If you are afraid of sending the Original send a US notarised copy.
The intention of the document is to only prove your ties with your parents.
If you do not have one or do not wish to furnish one, you can still try.

I will start working Jan/2007 as OPT. The company will apply H-1b for me after April.1st. At the same time, I also apply for phd program and I am not sure if I can get school offer. I believe I will know the result of phd application before the H-1b gets approved.
My question is:
If I get school offer, I know it is easy to cancel H-1b but how to cancel change of status? what is my status after I leave the company and before I go to school? what do I need to do to keep OPT until enrollment?

I'm creating a car game. i managed to get the car moving and all, but i dunno how to make the car collide with the obstacles when it hits it.

My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.
However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).
Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?
More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)
Please let me know as soon as possible.

I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.

I had applied for an EAD and AP renewal in April 09. While I received my EAD and AP at the end of April 09, the EAD case in CRIS was still showing "Initial Decision".
Today I got a random email from CRIS saying that my EAD case is in post-decision activity and that they mailed my card in April 09 (DUH!!!).
When I go to check my cases in CRIS, my 485, EAD, AP from last year and AP from this year all show a soft LUD on 12/3/10.
Does this mean I have been preadjudicated? Or is this just a random event? Or does it mean dark clouds ahead???????

Did you move to a state, which comes under Nebraska Service Center? Hence your 485 application would have got moved to NSC.

Reapplied for i140 in June 2006 under new company, RFE recived 1 week back.

Hi,
I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.
But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.
Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.
And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.
Is there a way to come out of this situation?
Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.
