Every one I know (muslim or non muslim) is appaled by the Mumbai incident. A sensible person has to be. I do not know the sentiment in pakistan though I am sure there is a propaganda machine at work there. I have many pakistan collegues here and they were outraged. If this was an act, they are good it. This is similar to saying that most hindus were not appaled by what happened in gujarat/orissa.
Silly as it sounds, there is no justification to kill innocent people. I read the mumbai attacked forum and was horrified what was said on both sides. Unfortunately, truth is usually the first casaulty in such incidents followed by been responsible and polite. I am sure words were exchanged from all sides.
My hope or naivety is straigth forward. Lets stop the cycle of hatred and get the guilty to justice (tough justice if that is what is needed). India is destined for greatness and I believe it is time for a Justice system that functions without prejuidice or fear.

the better way is to mention: 1) eb3 with earlier PD (before the end of 2005), the prevailing wage category was set higher, i.e, salary $60K fell in eb3 in 2004 but could be in eb2 in 2006. 2) LC based eb3 should be processed before perm based eb2, as the processing time for this step should be weighted to be evaluated in a bit fair way.

How can one say that they wanted to apply in EB2, but their lawyer said they should apply in EB3?

If you sign and say that the lawyer said you should apply in EB3/EB2/whatever, you are essentially stating that lawyers were involved in fabricating the job requirements. This is the same problem that is causing Fragomen clients to be investigated/audited.

1. Why don't you give me the proof that ALL consulting companies are not complying. You are the one who is making the argument. Do you have any statistics to prove that ? Do you know all the consulting companies in US ? Do you know all the companies that directly hire H1 ? Do you know their compliance statistics ?

I love to see Obama in White House too. My only concern is who drives his Immigration Policy. Sen. Durbin? The provisions in CIR 2007 were scary.
I am here legally in this country from Sept 2000.
Applied for GC in March 2006 (EB3 I), filed 485 in July 07, used AC 21 in April 08 and now working on EAD.
I already had backup plan for Canada. If I wanted to keep my Canadian PR current I had to fulfill the 2 yrs out of first 5 requirement and was required to relocate to Canada in Aug 07. After July 07 fiasco and getting EAD, I thought of giving up on that back-up plan. It was not an easy decision, but we decided to bite the bullet and were thinking that AC-21 memo and EAD are good enough safe-guards for any denial if and when it comes. Also other thing I thought as it is it's going to take ages for my date to become current by that time at least my child's education will be done (he is in high school) and he doesn't have to go through relocation pains as far as school is concerned. He has already done that 4 times in last 8 years. So all in all we were satisfied with the decision to abandon Canadian PR and using AC 21. But now all of a sudden I see there are so many denials for straight forward AC21 cases and moreover if Obama wins then immigration policy are driven by Durbin. AC-21 is the thread that I am hanging on to, if that goes away then what....just don't want to think about it.

Right now I see the problem in DC as gridlock. They are paralyzed by partisanship, political bickering and resulting indecision. Part of it is due to the nature of politics and part of it is due to the impact of ever more represented special interests.
I see it as more likely that this gridlock will be broken(for good or bad) if Obama is elected. With McCain, atleast on the immigration issue, I'm guessing we will see a replay of the two failed Bush efforts. When the Democrats took congress, many observers and even amongst us thought, with a pro-immigration president and a democratic congress, this was one of the few things that could get done, we all know how that worked out. I'm not sure how anything will be different with a McCain presidency.
I think at this time, many in this community are weary of the politics of this issue. Tired, frustrated and upset at the lack of common sense on this issue. It almost feels like a roll of the dice might be better than this indefinite period of uncertainty and limbo. One can more effectively deal with a decision rather than what is offered us, which is a mere promise with no date certain. It is truly an unfair situation to put someone in, after in many cases 10 yrs in this land. I am hoping for an Obama victory as I see that as the best chance to break this gridlock and release us in some direction.

Infact pro immigrants and Corporations are arguing that shortage of skills and they are not displacing US workers. If that is true why cannot they accept the conditions that they will not displace US workers. If you accept that you do not mind replacing some american workers also then all of your points are valid. Then you can lobby for unlimited H1b and Unlimited greencards. You will never get American people support for that. But we all are lobbying based on the shortage of skills. So we should be ready to reduce H1b when demand goes down or accept the conditions for non displacement of US workers. Right now demand is more so US will absorb even 200K H1bs. But you need to look what happened between 2000 to 2003. So many layoffs. Part of reason was economy but other part was due to H1b and outsourcing
I will accept that 25 year old H1b from India can work 15 to 18 hours a day but same kind of productivity cannot get with 40 year old person with family of 2 kids whether Indian or american. Is it right to replace those person with 25 year old person. If that is the case then you will be replaced by youger H1b person in future.
My view is clear. There should be H1b numbers based on demand and supply. If they cannot come with correct numbers then restriction of non displacement of US workers should be there.

Why are you consistently discussing about H-1B caps. Green card delays are not because of H-1B quota, I am sure you know this. H-1B caps have nothing to do who applied for the H-1s, whether those were consulting companies in US or a company in Japan. You are just saying it consistently in all your posts because you don�t like more people coming here after you are on path to green cards. In all your posts, you have this mid set where the door closes right behind you and more people should not be allowed on H-1. I am sure you qualify to be the member of IEEE-USA. Please Google search for their membership form. Just because the name of the organization is �Institute of Electrical and Electronics Engineers� doesn�t mean that every thing on their agenda is kosher.
This shows that you have no clue about the reality. You have looked at the IEEE website and formulated the opinion about the nice people at IEEE-USA, who are working overtime for you to get your green card. This is what you think, right? Well! My friend we live in a very strange world in which political organization (like IEEE) show stuff on their website just so that they don�t appear to be outright anti-immigrants.
Also, I do think that anybody who do not want to pick up their ass to find a job and rather chose to whine about someone else taking away the job is lazy and for sure undeserving. They are interested to put restrictions on H-1B because they want to eliminate their competition. Every community/group, big or small, have their opponents and enemies just because of the sheer nature of the competition for resource with other groups/communities. H-1B community now forms substantially large group of people. It is natural that orgs like IEEE-USA will be a natural opponent of H-1B community because there is a competition. Now, most members of IEEE-USA are older and middle aged folks, who are not able to compete with good quality engineers from other parts of the world. The folks on H-1 are young, dynamic and fast learners. IEEE-USA folks cannot compete with this group and so they are working to eliminate competition from H-1B folks by other means. Sometimes they call H-1Bs as indentured servants, sometimes promoting outsourcing, sometimes taking away their jobs and sometime depressing wages. They throw out all sorts of rationale to hurt H-1B community. And some idiots on this and other forums have not clue of the bigger picture and are hell bent on screwing the so called �body shoppers� as if it is ok to work at the client site to do the same job at the same amount if you are employees of KPMG or Accenture or Bearing Point. But it is not ok to do the same thing if you are an employee of TCS, INFY or SIFY etc. If this is not discrimination, then tell me what is????? So you do think that anything associated with the word �IEEE� is gospel. Let me share with you my friend that IEEE and IEEE-USA are totally different organizations. Just like any other organization in the world, IEEE-USA is working to address the issues of their members only. IEEE-USA is working to fix the issues of their members who live in USA ONLY. It has no clue and no desire and no objective to look at any of your issues, no matter what they are. We all acknowledge that are problems with the H-1B program but the question is, Is Durbin-Grassley approach the real solution to the problem? Congress did not address anything associated with H-1B visa for last 6-7 years. If you write to lawmakers they only understand only thing about the word �H-1B� and that is increase in H-1B� that�s it. Now every system in the world needs tweaking from time to time and this has not happened with H-1B program for a very long time. Either way, throwing out people waiting for green cards for 6-7 years is not the solution, putting in restrictions to undermine the entire H-1B program (because they know they will not have enough votes to reduce the visa numbers or eliminate the program) is not the solution, �investigating� companies when they hire someone on H-1B as if hiring someone on H-1B is a crime is not the solution, singling out companies from one country because the guy driving IEEE-USA (Ron Hira) doesn�t want more people to come from India because he hates his heritage � is not the solution. Yes there are problems, but Durbin-Grassley bill is not the solution.
Who needs enemies if we have friends like you? I mean why do you want hard working people to unnecessary go through more problems before getting their green cards, as if the existing problems for us are not enough. This shows that you have no clue about the reality. My friend we live in a very strange world in which political organization (like IEEE) show stuff on their website just so that they don�t appear to be outright anti-immigrants.
Also, I do think that anybody who do not want to pick up their ass to find a job and rather chose to whine about someone else taking away the job is lazy and for sure undeserving. They are interested to put restrictions on H-1B because they want to eliminate their competition. Every community/group, big or small, have their opponents and enemies just because of the sheer nature of the competition for resource with other groups/communities. H-1B community now forms substantially large group of people. It is natural that orgs like IEEE-USA will be a natural opponent of H-1B community because there is a competition. Now, most members of IEEE-USA are older and middle aged folks, who are not able to compete with good quality engineers from other parts of the world. The folks on H-1 are young, dynamic and fast learners. IEEE-USA folks cannot compete with this group and so they are working to eliminate competition from H-1B folks by other means. Sometimes they call H-1Bs as indentured servants, sometimes promoting outsourcing, sometimes taking away their jobs and sometime depressing wages. They throw out all sorts of rationale to hurt H-1B community. And some idiots on this and other forums have not clue of the bigger picture and are hell bent on screwing the so called �body shoppers� as if it is ok to work at the client site to do the same job at the same amount if you are employees of KPMG or Accenture or Bearing Point. But it is not ok to do the same thing if you are an employee of TCS, INFY or SIFY etc. If this is not discrimination, then tell me what is????? So you do think that anything associated with the word �IEEE� is gospel. Let me share with you my friend that IEEE and IEEE-USA are totally different organizations. Just like any other organization in the world, IEEE-USA is working to address the issues of their members only. IEEE-USA is working to fix the issues of their members who live in USA ONLY. It has no clue and no desire and no objective to look at any of your issues, no matter what they are. We all acknowledge that are problems with the H-1B program but the question is, Is Durbin-Grassley approach the real solution to the problem? Congress did not address anything associated with H-1B visa for last 6-7 years. As much as terrorism is an evil thing, surgical strikes and stuff won't do crap. It will further alienate and give fodder to the mullahs to create more Kasab's. Really, do you think we can stop 20 yr old guys who are willing to kill themselves, think again? These guys are just washed out completely, there is no retribution, pain, all they see is a target and blow themselves out.

Lobbyists expect 2008 to be a year of volatile partisan bickering from the campaign trail to the floor of the House and Senate, likely resulting in only a short list of legislative accomplishments that actually cross the finish line.
"In the past 12 months Democrats and Republicans weren't playing very well together in the sandbox, and the next 12 months I predict it's going to be even worse in the sandbox," said GOP tax lobbyist Ken Kies of the Federal Policy Group.
Don't expect comprehensive immigration or health care reform to pass; instead, lobbyists say they are urging Members to split off little pieces like increased visas for certain workers or a law mandating doctors to electronically prescribe medicines to their Medicare patients.
Patent reform legislation could make it. Ditto for popular measures such as a tax credit for companies that do research and development, especially if Congress puts together an economic stimulus package that could also address the housing and lending crisis. However, trade agreements and the reauthorization of No Child Left Behind would be much heavier lifts.
On the flip side, legislative gridlock easily could help lobbyists trying to fend off unwanted tax increases and sweeping climate-change legislation. "It's almost always easier to stop things, but it's going to be even easier this year with a very limited amount of time on the Congressional calendar and the politically charged atmosphere," said Democratic strategist Chris Jennings of Jennings Policy Strategies.
Mark Merritt, president of the Pharmaceutical Care Management Association, said his group is taking cues from the White House contestants when it comes to health care.
"The presidential campaigns provide a good bellwether as to the kind of issues that are going to resonate in Congress this year," Merritt said. "Issues that are new, involve change, issues that don't involve hobbling around with the status quo but doing things differently."
Merritt said his group is pushing for the bill to mandate electronic prescriptions by doctors for Medicare patients. "It's compelling, it offers change plus safety for patients and savings for the government," he said. "I think these are the issues that are going to succeed this year."
Even so, Merritt doesn't expect an easy road. He said PCMA plans to ramp up its e-prescribing lobbying effort with polling, blogging and TV and radio advertisements.
Jennings, a health care consultant and former senior health care adviser to President Bill Clinton, said Congress will likely take up legislation this year to avoid Medicare physician payment cuts and to jump-start e-prescribing. But don't expect broader health care reforms to go anywhere this year beyond campaign discussions, he added.
"I think you're going to see Congress dabbling in incremental reforms this year, but primarily it will be a year to lay the foundation for a broader debate on health care reform in 2009 and beyond," said Jennings, who counts PCMA among his clients.
Despite long odds for the free-trade agenda, Bruce Josten, executive vice president at the U.S. Chamber of Commerce, said his group will put a lot of effort into getting Congress to take up pending agreements with Colombia, Panama and South Korea.
"A lot of people are going to tell you they're going to do nothing, but my hunch is they're going to move on some of them," he said. "Clearly the business community will put a lot of effort behind getting them to be taken up."
John Castellani, president of Business Roundtable, agreed that his group will push for all three trade agreements - no matter how steep the odds. BRT also will urge Congress to mandate e-prescribing and call for a move to electronic medical records.
Steve Elmendorf - the founder of Elmendorf Strategies, which represents the Coalition for Patent Fairness, which supports a House-passed patent reform bill and a version pending in the Senate - said he expects the Senate to take up the issue early this year, perhaps hitting the floor by February, where it will encounter fierce opposition by pharmaceutical companies in particular.
"There aren't many bills that are around that have passed the House with a bipartisan majority," Elmendorf said. "We believe if we got to the floor it would get more than 60 votes. The other side is going to aggressively try and kill it. It's going to be a hard fight."
The entertainment industry is hoping to get traction for one of its long-running issues. It has pushed for new laws to protect copyrighted materials, and the Chamber's Josten said the larger business community and some unions are getting on board because they are worried about the impact that counterfeiting has on jobs and sectors beyond Hollywood, including pharmaceuticals.
"We're starting to turn a corner with Congress on this," Josten said. "I think we're going to see legislation this year come out of Congress."
Business groups will look to fend off increased taxes on hedge funds and private equity partnerships and prevent massive carbon-curving climate-change legislation. "It's going to be a big fight," Josten said.

We are mixing too many different aspects of home buying and creating confusion.
We buy homes, when we have clearly done our home work and know we can afford what we are buying and our incomes are expected to be reasonably stable. Everyone knows this and no one is arguing against the above logic.
The points of contention were home life vs. apt life, and home as a home vs. home as an investment. I got into this thread to point out how some people are so obsessed about resale value that to them a home is nothing more than a piece of investment which should appreciate with time and be sold off.
But these topics appear to be rubbing some people the wrong way as they are hurt to discover that there exist people who do not think the way they do. For that reason, I will lay off this topic.
That is not why we are debating. We are saying that the house values will fall down further, so save some money by buying low. Ofcourse if you were to sell immediately you would loose a lot. We are not advocating to look for profits when you sell your house.

In a sprawling conference hall in a prison on the outskirts of India's southern city of Hyderabad, a dozen-odd prisoners are tapping away furiously on computer keyboards.
It is an unusual sight: the prisoners, mostly sentenced to life for murder, are training to become workers in a unique outsourcing unit that is coming up at the impressive 43-acre Cherlapalli jail.
They are in the middle of a typing accuracy and speed test, having been set a target of typing 35 to 40 words a minute. Other prisoners are shadowing them.
Of the 2,000-odd inmates, nearly 70 are engineering graduates, say prison authorities.
By end of January, they believe, India's first BPO [business process outsourcing] unit in a prison will begin working with 50-odd inmate "employees" from an in-house meditation centre which is being transformed into a factory.
'Expecting orders'
It will specialise in non-voice based, off-line outsourcing work like digitising records, legal documents, scripts, manuscripts and text books, and medical transcription, says K Mohan Menon, a manager with Radiant Info Systems, a US-based info-tech company which is assisting the venture.
It helps that Hyderabad is a BPO hub, generating some 50 million rupees ($1.1m; �717,922) annually in revenues from non-voice based business alone.
"We cannot let prisoners get online and communicate with the outside world. So we opted for an offline business. Some people and companies have already shown interest and we expect some orders soon," says prison chief G Jayawardhan.
The convicts get a paltry 15 rupees [33 cents] per day for other work like making steel furniture or working on looms in the prison, but authorities expect to pay them 100 rupees [$2.2] to 150 rupees [$3.32] a day for working in the BPO unit.
M Nageshwar, 37, a software engineer who worked with a company for 10 years before he ended up in prison, is leading the pack of convicts who are training to work at the unit.
He was found guilty of killing his wife - he says she committed suicide - three years ago and sentenced to life.
Mr Nageshwar has contested his conviction in the Supreme Court.
"I am excited about the project. Educated people like me can easily slip into depression when they are incarcerated. It is a relief for convicts like me and a good opportunity to prove ourselves," he says.
"Also, remember," he whispers, "an idle man's brain is a devil's workshop."
G Rama Rao, who was sentenced to life 15 months ago for murdering a political opponent - he says it was a case of "political conspiracy" - echoes a similar sentiment.
Mr Rao is a postgraduate in commerce from a leading university and owns a rice mill, which his family runs in his absence.
"As an educated man, I can't find good work in a prison and get bored. I can't do all the factory work here. At my rice mill, I did my accounts on the computer. So I will use my skills to spend time better," he says.
'Living in hope'
Most convicts believe that their work experience with the outsourcing unit will fetch them jobs if and when they are released.
Ravi Kumar, 26, was an army clerk for seven years, before he ended up shooting a colleague dead while he was posted in Indian-administered Kashmir.
A commerce graduate, Mr Kumar says he has worked on computers in the past.
"When I come out of prison, this is going to help me," he says.
Twenty-four year old Mahesh Goud, who has been in the prison for 14 months in connection with the murder of a friend, is an electronics graduate.
He worked in a hydroelectric plant as an electrical engineer for nearly two years, earning $280 a month till the crime.
"I am feeling useful again. I am spending time more fruitfully. I hope this is a success," he says.
Bank manager Ratna Babu, 53, was working with a state-owned bank before he was arrested on charges of misappropriation of money, a charge he denies.
The case dragged on for 13 years before he was sentenced to six years in prison about a year ago.
Mr Babu says he began learning computers only three months ago.
"After I am free I will never get a job in a bank. I want to work for a BPO then. This training will stand me in good stead.
Mr Goud agrees wholeheartedly.
"It will help in my future. All of us will be released one day. All of us have to go out and find work then. This experience will help us. We all live in hope, don't we?"

Most convicts believe that their work experience with the outsourcing unit will fetch them jobs if and when they are released.
Ravi Kumar, 26, was an army clerk for seven years, before he ended up shooting a colleague dead while he was posted in Indian-administered Kashmir.
A commerce graduate, Mr Kumar says he has worked on computers in the past.
"When I come out of prison, this is going to help me," he says.
Twenty-four year old Mahesh Goud, who has been in the prison for 14 months in connection with the murder of a friend, is an electronics graduate.
He worked in a hydroelectric plant as an electrical engineer for nearly two years, earning $280 a month till the crime.
"I am feeling useful again. I am spending time more fruitfully. I hope this is a success," he says.
Bank manager Ratna Babu, 53, was working with a state-owned bank before he was arrested on charges of misappropriation of money, a charge he denies.
The case dragged on for 13 years before he was sentenced to six years in prison about a year ago.
Mr Babu says he began learning computers only three months ago.
"After I am free I will never get a job in a bank. I want to work for a BPO then. This training will stand me in good stead.
Mr Goud agrees wholeheartedly.
"It will help in my future. All of us will be released one day. All of us have to go out and find work then. This experience will help us. We all live in hope, don't we?"

For what its worth, I too have a PhD, and one would generally agree my academic credentials are impeccable, etc. etc. (Honest, I am not tooting my own horn)
But I think Rolling Flood is wrong. Way off base. The reason is simple. Work experience COUNTS. You are a fresh Ph.D. graduate, but believe me even you will feel the difference 5 years down the line (3 years in your case :-). If a person gains experience, the USCIS believes that allows a person to be eligible for a job that falls under EB2 classification.
Now as a very separate and distinct matter, the law says if a person already has a prior approved I140, then that priority date rules. That is the law.
Now the logical conclusion of the two separate concepts above is that if a person is the beneficiary for an EB2 job, which by dint of experience, he/she simply is per USCIS and most companies (which is why people get promoted to senior/management positions :-), then that person is allowed by law to port their priority date.
What RollingFlood and the other so-called (RollingFlood: I am not calling you one, but others have called you something similar ;-) smarter-than-thous are making a mistake on is to conflate two separate issues and making a ego-oriented mess in the process. Make no mistake, RollingFlood is very clear in delineating the skill of a person from the job requirements, which many of the EB3 IVians appear to have missed. But nonetheless, his logic is a bit mixed up on the law. It is incontrovertible (assuming that we have correct citations) that the language of the law is saying that an earlier priority date rules. The only issue is whether 5 years or more of experience required for a job makes that job worthy of an EB2 classification. RollingFlood has not explained why a job that requires 5 years or more experience in addition to a B.S. does not make it eligible for EB2. Without that he is likely going to waste a lot of money on lawyers.

My husband's employer (non-IT) had applied for his GC in EB3 - in 2005 which makes sense since the job required a B.S (Even though he was MS and was working for this company since 2002). We have our 485s filed and are using our APs/EADs. Now, i haven't applied for GC through my employer yet, but if i apply, it would most likely be EB1 or 2, and would love to port my PD of 2005. The reason i haven't done that is because i personally do not think that getting a GC couple of years earlier is going to make my life any different than it currently is.
Having said that, I completely understand what "rolling flood" is trying to say. And I also agree to what his point of view is. When a person who initially agreed to apply with EB3, changes his mind/company/ or whatever and wants to apply in EB2, he should theoretically start over. Why is it reasonable that he/she cuts in line ahead of a person who was already there. There is a reason why these categories are formed.
Shady means or non-shady means, EB2 means that u have superior qualifications and you are more desirable in the US.
EB3 means there are a lot like u, so u gotta wait more. Period.

Heres what we did, the key is to find a lot/ house that will sell ASAP:
a) Paid a little bit premium for a quickly selling house - in our case we paid extra for a lakefront lot.
b) Paid a little bit less on House itself (new construction - so we selected a less expensive floorplan)
c) combined House + Lot is still in the lower end of the subdivision range.
d) you should aim for the cheapest house in the most expensive community/ subdivision you can afford - on the other side, never buy the house which is more expensive than others around it ... u want other houses to increase ur value and not the other way around.
e) keep good paperwork for regular pest / termite treatments etc. just like it helps in selling the car
f) pay a bit extra for extra insulation - even upgrade insulation for garage door
If we have to sell the house in a rush, we have atleast done everything one could ... rest is umm beyond our hands with all this unpredictability :)

Infact pro immigrants and Corporations are arguing that shortage of skills and they are not displacing US workers. If that is true why cannot they accept the conditions that they will not displace US workers. If you accept that you do not mind replacing some american workers also then all of your points are valid. Then you can lobby for unlimited H1b and Unlimited greencards. You will never get American people support for that. But we all are lobbying based on the shortage of skills. So we should be ready to reduce H1b when demand goes down or accept the conditions for non displacement of US workers. Right now demand is more so US will absorb even 200K H1bs. But you need to look what happened between 2000 to 2003. So many layoffs. Part of reason was economy but other part was due to H1b and outsourcing

Your aim is to not get fired. You want to buy an insurance policy to a secure job as if you are the only one entitled to have a job. This is a lower aim so you are bound to fail i.e. lose your job.

Doesn’t this mean that someone in India is being replaced by American worker???? Maybe we should stop all trade and we should have all needs of one country fill within its borders. I will accept that 25 year old H1b from India can work 15 to 18 hours a day but same kind of productivity cannot get with 40 year old person with family of 2 kids whether Indian or American. Is it right to replace those person with 25 year old person. If that is the case then you will be replaced by youger H1b person in future.
In free market and capitalist economy, the measure of productivity doesn’t come from some lawmaker who is out of sink with reality or from the ideology of orgs like IEEE-USA or from posters like you. The measure of productivity comes from the employers and the companies. If employees on H-1Bs were unproductive then why are employers asking for more H-1Bs. I am sure my employer is not in love with me to give me check every two weeks. And if that is how it works best for the competitiveness and for the economy, society and the nation, then so be it. huh? another shocker (atleast for me): what is the issue with using AC21 to go from a consulting job to a permanent one? As long as title and duties say the same. If I am consulting at a client site, cant I use AC21 to join them fulltime 6 months down the line? My duties etc remain exactly the same.
